Terms & Conditions
These terms of business apply to agreements entered into between OUCH (hereafter the Provider) and patients in treatment at OUCH (hereafter the Customer).
Formation of the agreement
A binding agreement between the Customer and the Provider is considered concluded when the Customer’s order is received on the Provider’s server.
The Provider sends an order confirmation as soon as possible, in the form of an invoice by email, stating the order number, the Customer’s name and address, the method of payment and an overview of the service ordered.
Prices
All prices are daily prices and apply only on the day of ordering. We reserve the right to correct pricing errors on the website.
All prices are exempt from VAT, as healthcare services are not subject to VAT.
The Customer’s rights and obligations when purchasing services
The Provider warrants that the service ordered will be performed in a professional and competent manner but gives no guarantee that the service will lead to a particular result for the Customer.
The service is performed in accordance with the information in the Customer’s order and any other information received from the Customer. The Provider accepts no responsibility for errors or deficiencies in the service that are due to information received from the Customer.
In the event of errors or deficiencies in the service, the Provider is liable for the Customer’s direct financial loss under the general rules of Danish law on damages. The Provider can in no case be held liable for the Customer’s indirect loss or consequential damages.
The Customer is responsible for taking out appropriate accident insurance.
Cancellation and no-shows
If a treatment appointment has been booked, the Customer must, in the event of being unable to attend, cancel no later than 6:00 PM on the day before the treatment. If this does not happen, the Customer must pay a fee corresponding to the agreed price for the treatment, unless the failure to cancel within the deadline is due to extraordinary circumstances.
The Provider reserves the right to cancel the delivery of a service against a refund of the purchase price.
Notification of changes
If there are changes to the service ordered, the Provider will notify the Customer as soon as possible by email or SMS.
Right of withdrawal
No right of withdrawal applies to the Provider’s services, as these are not covered by the right of withdrawal under the Danish Consumer Agreements Act.
Payment terms and options
Payment can be made with the following payment cards: Dankort, VISA/Dankort, VISA, Euro Mastercard, Visa Electron, MobilePay and Maestro.
Payment for services is made on ordering against an invoice from the Provider.
The Provider’s payment solution is based on the SSL standard, which means that the information provided in connection with the payment transaction is protected by means of encryption.
Personal data
The Provider obtains personal data about the Customer when the Customer orders a service offered by the Provider, including newsletters from the Provider, provided the Customer has given consent to this.
The information is used to deliver and ensure the service ordered and to target the Provider’s offers to the Customer.
The guidelines for the Provider’s collection, use, storage and deletion of the Customer’s personal data follow from the Provider’s privacy policy.
The Customer has the right at any time to gain insight into what information is registered in the Provider’s database. If the information is incorrect or misleading, the Customer has the right to have it corrected, deleted or blocked, just as the Customer can withdraw consent at any time.
Any request from the Customer to object to the registration or processing of their personal data, or to withdraw consent, can be made to [email protected].
Furthermore, the Customer can at any time complain about the processing of their personal data to the Danish Data Protection Agency.
The Provider’s reservations
The Provider reserves the right regarding typographical errors, changes to VAT and duties, and delayed or deficient delivery as a result of force majeure events.
We further reserve the right regarding any errors and deficiencies in prices, both online and in printed material.
